Terms of Use

These Terms govern your use of Found It, a local-first household item memory, organization, declutter, poster-export, and optional cloud-recovery app distributed through Apple platforms.

Important. By downloading, installing, accessing, or using Found It, you agree to be bound by these Terms. If you do not agree, do not use the app.
Current public MVP disclosure. Found It's current public MVP centers on item capture, lightweight room-plus-location memory, search and recovery, declutter/process workflows, poster/export tools, optional iCloud backup and restore, and optional user-configured AI recognition. Legacy or experimental modules may still exist in the codebase or restored archives, but they are not promised as part of the current public MVP unless we explicitly enable them in your build.
Important credential disclosure. Your custom AI API key and local-only connection credentials stay only on the device where you enter them. They are not included in Found It's cloud backup payload.

These Terms form a legal agreement between you and Jinhui Cheng, and not with Apple. You represent and warrant that:

Found It is a tool for recording what you own, where you placed it, how you want to manage it over time, and how you want to prepare certain items for declutter or sharing workflows. Depending on the version and platform, the app may include:

Some versions may also contain optional, legacy, region-limited, or experimental layout, spatial, or shared-archive functionality. Such functionality may be unavailable, incomplete, removed, hidden, or unsupported without notice.

3. License Grant and Restrictions

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use Found It on Apple-branded products that you own or control, as permitted by Apple's applicable usage rules.

You and we acknowledge that these Terms are concluded between you and us only, and not with Apple, and that we, not Apple, are solely responsible for Found It and its content, subject to applicable law.

5. User Content and Your Responsibilities

You retain your rights in the content you enter into Found It, such as item names, notes, room names, listing drafts, and photos. However, you are solely responsible for all content you create, import, store, export, share, or act on through the app.

Found It is not a professional organizer, warehouse operator, bailee, insurer, appraiser, broker, marketplace, logistics provider, payment processor, or legal/safety advisor. The app does not verify the legality, safety, value, ownership, or condition of any item and does not guarantee that an item can be found, preserved, sold, shared, donated, or safely stored.

6. Permissions, Cloud Features, AI, and Third-Party Services

If you enable custom AI recognition, Found It sends requests directly from your device to the endpoint you configure. You are solely responsible for:

You must not use the custom AI feature to transmit data that you are not legally authorized to upload or data that requires heightened protection unless you have separately confirmed that the provider and your use comply with applicable law.

6.3 Cloud backup and restore risk allocation

If you enable cloud backup and restore, you authorize the app to package and transfer a cloud archive through Apple's cloud infrastructure. That archive may include structured inventory/workflow data and image copies at the sync quality you selected, but it excludes the custom AI API key and local-only connection credentials. Cloud backup and restore may overwrite local data, may fail, and may not preserve every field, file, or state exactly as before.

6.4 Experimental, legacy, or hidden functionality

Some versions of the app may contain experimental, region-limited, hidden, restored, or legacy functionality, including optional layout, spatial, or shared-archive logic. We may enable, disable, modify, remove, or decline to support such functionality at any time, with or without notice, and we do not warrant its availability, correctness, continuity, or supportability.

7. Subscriptions, Purchases, and Refunds

Certain features may require an in-app purchase or subscription. Billing is handled by Apple, not by us.

Refunds, billing disputes, and purchase cancellations are handled by Apple under Apple's rules. We do not process App Store refunds directly. Refund requests generally must be submitted through reportaproblem.apple.com.

7.3 No guaranteed support SLA

If a subscription tier or marketing copy refers to support, restore help, or similar language, that does not create a guaranteed response time, uptime commitment, resolution deadline, or professional-services obligation unless we separately agree to one in writing.

8. AI Output and Generated Content Disclaimer

Recognition results, naming suggestions, category suggestions, declutter recommendations, poster text, listing content, and other generated outputs are provided for convenience only. They may be inaccurate, incomplete, unsafe, misleading, or unsuitable for your use case.

9. Device Security, Data Availability, and Backup Responsibility

Found It is local-first. If your device is lost, damaged, compromised, reset, or if local files are deleted, data may become unavailable. You are solely responsible for device security, Apple-account security, cloud settings, participant management where applicable, backup strategy, and credential rotation for any third-party services you configure.

We are not obligated to recover lost data, reconstruct archives, or restore corrupted or deleted item photos, exports, poster files, or cloud states.

Found It, including its code, design, interface, branding, and non-user-generated content, is owned by Jinhui Cheng or its licensors and is protected by applicable intellectual-property laws. No ownership rights are transferred to you.

12. Availability, Changes to the App, and Feature Gating

We may add, remove, limit, suspend, gate, or modify features, pricing, integrations, supported devices, supported cloud flows, and supported AI paths at any time, with or without notice, to the maximum extent permitted by law. We are not liable for the unavailability, discontinuation, or alteration of any feature, experimental module, or third-party integration.

13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOUND IT IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND.

Without limiting the foregoing, we disclaim all express, implied, or statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, data accuracy, and uninterrupted availability.

We do not warrant that:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

This exclusion includes, without limitation, damages for lost profits, lost revenue, lost savings, lost business opportunities, lost or corrupted data, lost images, device downtime, cloud-sync failure, failed sales or giveaways, property damage, reputational harm, or procurement of substitute goods or services.

This limitation applies even if a remedy fails of its essential purpose and even if we were advised that such damages were possible.

14.1 Maximum aggregate liability

To the extent liability cannot be fully excluded under applicable law, our total aggregate liability for all claims arising out of or relating to Found It or these Terms will not exceed the total amount you actually paid for Found It subscriptions or in-app purchases through Apple during the twelve (12) months immediately preceding the event giving rise to the claim; if you paid nothing during that period, our liability will be limited to the minimum non-waivable amount, if any, required by applicable law.

You agree to indemnify, defend, and hold harmless Jinhui Cheng and related persons from and against any claims, demands, actions, liabilities, damages, losses, judgments, settlements, costs, and expenses, including reasonable legal fees, arising out of or related to:

16. Termination

These Terms remain effective until terminated. We may suspend or terminate your license immediately if you violate these Terms, applicable law, or platform rules. Upon termination, your right to use the app ends immediately, but provisions that by their nature should survive will survive, including provisions on intellectual property, disclaimers, liability limits, indemnification, governing law, and dispute procedure.

17. Governing Law and Dispute Resolution

To the fullest extent permitted by applicable law, these Terms and all disputes arising out of or relating to Found It are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles.

You agree to first contact us at [email protected] and attempt to resolve any dispute informally for at least thirty (30) days before filing a legal claim.

Subject to mandatory consumer-protection rights that cannot lawfully be waived, the courts located in Hong Kong shall have exclusive jurisdiction over disputes arising from or relating to Found It or these Terms.

To the fullest extent permitted by law, all disputes must be brought only on an individual basis, and not as part of a class, collective, coordinated, representative, or private-attorney-general action.

18. Export Compliance

You represent and warrant that you are not located in a country subject to a government embargo or designated on any applicable prohibited or restricted-party list, and that you will not use or export the app in violation of applicable export-control or sanctions laws.

19. Changes to These Terms

We may update these Terms from time to time. The updated version becomes effective when published, unless we specify a later date. Your continued use of Found It after the effective date of an updated version constitutes your acceptance of the updated Terms, to the extent permitted by law.

20. Severability and Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law. These Terms, together with the Found It Privacy Policy, constitute the entire agreement between you and us regarding Found It and supersede prior understandings relating to the app.
